Terms & Conditions

Switchly is an AI-powered hiring and recruitment platform operated in India. It connects job seekers (candidates) with companies and recruiters (hirers) through intelligent matching, resume parsing, and AI-based candidate scoring. These Terms govern your use of the platform, website, APIs, and any related services (collectively, the “Service”).

You must be at least 18 years of age and legally capable of entering into binding contracts under the Indian Contract Act, 1872 to use this Service. By registering, you represent and warrant that you meet these requirements.

Recruiters must represent a legitimate business entity and have authority to post job listings and access candidate information on behalf of their organisation.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@switchly.in if you suspect any unauthorised access.

Each account is for a single user. You may not share your account with others or create multiple accounts to circumvent restrictions.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the platform.

As a candidate, you may upload your resume, build a profile, browse job listings, and apply to positions. You warrant that all information you provide — including your resume, work history, education, and skills — is accurate, current, and not misleading.

By uploading your resume and profile, you grant Switchly a non-exclusive, royalty-free licence to store, parse, display, and share your profile with recruiters who use our platform for the purpose of evaluating you for job opportunities.

You may request deletion of your data at any time from Account Settings. Upon deletion, your profile will be removed from recruiter searches. Applications already submitted will be retained per our data retention policy below.

As a recruiter, you may post job listings, review AI-ranked applicants, shortlist candidates, and schedule interviews. You warrant that all job listings are for genuine, lawful employment opportunities in India.

You may not use candidate data accessed through Switchly for any purpose other than evaluating candidates for the specific role they applied to. Re-selling, redistributing, or building databases of candidate information is strictly prohibited.

You are responsible for ensuring your hiring practices comply with applicable Indian labour laws, including the Equal Remuneration Act and the prohibition of discrimination under the Constitution of India. Switchly does not guarantee the suitability of any candidate for any position.

Free tier accounts are limited to 2 active job postings and 10 AI-scored applicants per job. Growth plan limits are as described on the Pricing page.

Switchly uses AI models to parse resumes, generate candidate scores, and provide hiring recommendations. These outputs are probabilistic and may contain errors. AI scores are advisory only — they do not constitute a guarantee of a candidate's suitability and should not be the sole basis for hiring or rejection decisions.

Candidates are never shown their own AI score. Recruiters must exercise independent judgement and comply with applicable employment laws when making hiring decisions.

We do not use candidate personal data to train our AI models without explicit consent.

You agree not to:

• Post fake, misleading, or fraudulent job listings
• Misrepresent your identity, credentials, or work experience
• Scrape, crawl, or programmatically extract data from the platform
• Attempt to reverse-engineer or bypass any AI scoring mechanism
• Use the platform to harass, spam, or send unsolicited messages
• Upload malware, viruses, or harmful code
• Violate any applicable Indian or international law

All platform code, design, trademarks, and content created by Switchly are our exclusive property. You retain ownership of content you submit (resumes, job descriptions), but grant us the licence described above.

You may not reproduce, distribute, or create derivative works from Switchly's content without prior written consent.

Growth plan subscriptions are billed monthly in Indian Rupees (INR). All payments are processed securely through our payment partner. Prices include applicable GST.

Subscriptions renew automatically. You may cancel at any time from Account Settings; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months.

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR JOB LISTING WILL RESULT IN EMPLOYMENT.

Switchly is a platform that facilitates connections — we are not a recruitment agency, staffing firm, or employer of record. We are not a party to any employment contract entered into between a candidate and a recruiter.

To the fullest extent permitted under applicable Indian law, Switchly's total liability for any claim arising out of or related to the Service shall not exceed the amount you paid us in the three months preceding the claim, or ₹5,000, whichever is higher.

We are not liable for indirect, incidental, consequential, or punitive damages, including loss of employment, loss of data, or loss of revenue.

These Terms are governed by the laws of India. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, with proceedings conducted in English in Bangalore, Karnataka.

We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice on the platform. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
